St. Mary’s Sued for Malpractice

An Ohio couple has brought a lawsuit against St. Mary’s Medical Center and Scott Orthopedic Center, claiming these facilities were negligent in their care and treatment, a New York Injury Lawyer reports.
Others were named in the suit as well, including another medical center and a doctor, as defendants, sources told a New York Injury Lawyer. The plaintiff was a patient of the defendants, beginning in February 2009. The complaint was filed in Cabell Circuit Court on September 22.

Merck Verdict Cut Significantly

The jury awarded the complainant against Merck & Co. $8 million in a lawsuit over its Fosamax osteoporosis drug, but a federal judge has cut that award to $1.5 million while uploading the verdict, a New York Injury Lawyer reports.
A U.S. District Judge in Manhattan denied Merck’s request for a defense verdict or a new trial. The jury gave a 72-year-old woman of Fort Walton Beach, Florida victory in her suit against the company. It was her complaint the she had developed osteoncrosis of the jaw, what is otherwise known as jaw death, from taking Fosamax.
According to the judge, the $8 million verdict was far too high. The plaintiff was allowed to take a reduced award of $1.5 million or to request a retrial to determine damages. “A significant damage award is warranted, but the $8 million deviates substantially from what would be reasonable compensation,” the judge told a New York Injury Lawyer. Merck has stated it will appeal the judge’s refusal to throw out the verdict entirely.

Legislation Introduced in Congress Against Campus Harassment, Reports NY Injury Lawyer

The suicide of a Rutgers University student whose sexual encounter with another man was streamed online by his roommate has prompted new legislation from a New Jersey senator, reports a New York Injury Lawyer.
“Tonight we call on one another to stamp out the bigotry and the harassment that [caused] this young fellow to take his own life at 18 years of age,” said Senator Frank Lautenberg, D-New Jersey. He was joined by other New Jersey Democrat legislators and Garden State Equality, a gay rights group that organized an anti-bullying rally at which the senator spoke.
The body of an 18-year-old student was recovered from the Hudson River, a week after he jumped from the George Washington Bridge. The bridge spans the river between New York and New Jersey, where Rutgers is situated. The student jumped from the bridge after two other Rutgers students allegedly made a streaming video of him and another man engaged in sexual activity.

Professors Had Sex Apartment for Undergrad Students, says New York Injury Lawyer

Family Tells Story of Grandmother Given False Cancer Diagnosis
