Two dead in car wreck involving semis

Anytime an 18-wheeler is involved in a car wreck, the results are never pretty, said the New York Injury Lawyer. Weight Loss Drug Changes Label to Reflect Liver Injury Risk

The Food and Drug Administration recently revealed more than a dozen cases of severe injuries to patient’s livers who used the drug orlistat for a duration of nearly ten years, said a New York Injury Lawyer.
Orlistat, also known as Alli and Xenical, will be changing its label to reflect these new risks, which were uncovered by the FDA’s review, according to New York Injury Lawyers.
The new label will include safety information warning patients that Orlistat will increase their risk for severe liver injury when taken over a period of ten years.
Lawyers clarified that the drug Orlistat does not “cause” liver injury so patients should be told to contact physicians and other health care professionals only if they experience symptoms that may include but are not limited to itchy, yellow eyes or skin, dark urine, light colored stool and/or a loss of appetite. Doctors in Staten Island and Westchester County look for these signs before they treat the illness.
Authorities estimate that nearly 40 million people worldwide have used Alli or Xenical and so far one case of liver injury has been reported in the United States involving Alli and twelve cases of liver injury have been reported in foreign countries involving Xenical.
It is strongly recommended to discontinue use of the drug Orlistat if any of these symptoms should or arise of if liver injury is suspected. Physicians and Healthcare professionals should report any of these findings to the FDA right away.
An Orlistat representative was not available for comment, according to New York City Injury Lawyers.

Family files wrongful death suit against city of Oak Ridge Oregon

Back in June, a retired school teacher was making a left hand turn in her 1965 Thunderbird when she was broadsided by a police car that was in pursuit of a speeding vehicle. The 91 year old woman was killed in the crash. Her family has filed a wrongful death suit against the city and is seeking $534,000 in the claim, says a New York Injury Lawyer. 

The 28 year old officer who was driving the patrol car that killed the woman will not face criminal charges resulting from the accident, but that is not good enough for the family of the woman who was killed. 

According to reports, investigators determined that the woman driving the Thunderbird was solely at fault because she failed to yield to a police vehicle. Had the officer been blaring his lights and sirens, perhaps that determination would have merit. There are specific laws regarding this situation if it occurs in The Bronx or Brooklyn. But the fact is the officer had no lights or sirens on at the time of the accident, and so it is easily assumed that the woman would not realize that there was a patrol car headed towards her. 

The family alleges that the city failed to provide appropriate training to its officers in the case of high speed pursuits and it was this negligence that caused the accident that killed their loved one, claims the Injury Lawyer of New York. The officer involved in the crash has been back at work since January and says that he has no recollection of the accident at all.

Woman accused of killing CHP Officer in crash now faces civil suits as well, cites NY Injury Lawyer


A 23 year old woman who was flying high on Methamphetamine at 67 miles per hour crashed into a California Highway Patrol officer, last June, killing him instantly, claims a New York Injury Lawyer. The accident left the family of the officer devastated, and the driver who is accused of killing the man behind bars. 

Reports obtained by authorities stated that the family of the victim is now filing civil suits against the woman in addition to the criminal charges being held against her. They want to make certain that they send a message that what the woman did was wrong and they state that all of the money that is won in the case will go towards helping others, in particular young people who want to become police officers. 

The Lawyer also stated in his report that the widow of the officer who was killed, along with his parents, had filed a wrongful death lawsuit against the woman in addition to a complaint of personal injury and property damage. The woman who killed the officer is still in custody and could face 15 years to life in prison just from the criminal charges filed against her. 

The NY City Injury Lawyer said that the civil cases will likely result in fines that could become quite steep. Friends and family of the officer say that he was a good man who just wanted to keep people safe. The woman is scheduled to go to trial in San Luis Obispo for her crimes.

Bus Accident Kills 1, Injures 8 in Port Jefferson

An accident in Baiting Hollow ended in the death of one and injured eight others. It occurred on Sound Avenue when a tractor-trailer collided with a school bus for special-needs children. So far, it seems that the fatality and most, if not all, of those injured, were adults.
According to a police chief in the area, the bus was the property of Maryhaven Center of Hope in Poor Jefferson. The tractor trailer was carrying a load of sand. According to New York Injury Lawyers, the street is both hilly and curved, which made it easy for the bus and tractor trailer to lose control when they sideswiped each other.
A dispatcher for the Maryhaven Center of Hope told New York Injury Lawyers they are a program for children with special needs. At the time for the accident, there were six students and two staff members on the bus.
According to a spokeswoman for Peconic Bay Medical Center in Riverhead the one fatality was an adult.
There were a total of five victims, including the one that died, taken to Peconic Bay Medical Center, the spokeswoman told New York City Injury Lawyers. The ages and condition of the remaining injured passengers is unknown at this time.
A Riverhead police lieutenant indicated that the person who died was on the school bus.
The other injured persons were taken to John T. Mather Memorial Hospital in Port Jefferson. A spokeswoman for the facility said there were four victims brought there, all of them adults. She also stated none of them were in danger of dying of their injuries and the patients would likely be released very soon. These accidents are common on the Long Island Expressway in Nassau and Suffolk Counties.
One victim was sufficiently injured as to be taken to a medical facility by a Suffolk police helicopter.
Riverhead Police closed the road after the crash.
A nursery worker who knows the area said that speeding was very common on that rural road where the accident occurred.
“You have to take your time and go slow,” she said.

Christmas crash kills two, alcohol involved,

A man could be sentenced to prison after a Christmas Day crash in which he was at fault killed two people, reports a New York Injury Lawyer. The Highway Patrol is continuing to investigate the accident which occurred early Christmas morning when the driver of an SUV was said to have veered too far to the right, causing the accident that left two people dead. 

The Lawyer stated in his report that the driver was charged with driving under the influence of alcohol and issued a DUI. He was arrested and being held on a $51,000 cash bond. A trial is being scheduled for the man. A family member of one of the victims of the crash expressed her forgiveness for the accident, saying that she understood that it was not intentional and that she felt sorry for the driver of the SUV who caused the crash. 

The holiday season is notorious for accidents involving alcohol. But no matter how tempting it may be to tie one on for Christmas or party all night in celebration of the New Year, the holidays are no time to test ones limits by drinking and driving. No one is immune to accidents. Hit-And-Run Driver in Massapequa Park Pleads Not Guilty

A hit-and-run driver from Massapequa Park is attempting to prove he did not run from the scene of an accident that killed a pedestrian from Bellmore. The 45-year-old defendant was silent was at his arraignment in Nassau County First District Court in Hempstead.
He is now free on $10,000 bail, but his driver’s license has been suspended for 30 days to allow a judge to review the defendant’s record and assess the possibility of him driving again at some point in the future. Leaving the scene of an accident with death is a felony charge, which gives the defendant plenty of motivation to fight it.
NY Injury Lawyers learned from Nassau police the following details: The defendant was driving down Sunrise Highway in Bellmore when he struck and killed a 64-year-old man from Floral Park, at around 9 in the evening. The next afternoon, the defendant turned himself in to Nassau police at their headquarters in Mineola.
When the suspect was arraigned there were more than a dozen of his family members in attendance to show their support for him at the hearing. Any questions directed to the defendant were answered instead by his attorney.
The attorney maintains his client feels great remorse and is fully cooperating with authorities to get the bottom of what really happened in the incident that ended the life of a man from Bellmore.
“He’s distraught and feels terrible for the deceased and the deceased’s family,” the attorney told Nassau County Injury Lawyers. “It’s just a tragedy all around.”
According to police sources, the victim was attempting to cross Sunrise Highway near Washington Avenue in Bellmore when a dark-colored vehicle struck and killed him. After the accident, Sunrise Highway was closed for four hours as police attended to the scene.
Allowing someone to get away with causing great harm is not justice. There are costs to pay, if not medical, then emotional and mental. Lawsuits continue to grow against Yasmin birth control and its unexpected side effects

NY Product Liability Lawyers say the lawsuits against Bayer Corporation continue to grow in regards to the it’s birth control products Yaz and Yasmin.

In its most recent case, a woman has charged that Yaz birth control pills led to a severe gall bladder problem resulting in surgery.

“I was never warned properly by either Yaz birth control or Bayer Corp. about this type of a side effect,” the woman claimed. She goes on to charge that Yasmin Birth Control and Bayer were aware of the risks and neglected to warn women of the possible serious health risks.

“This woman had to have her gall bladder removed and continues to suffer with severe stomach cramps and frequent diarrhea,” said a NY Product Liability Lawyer and added, “She never would have used this product had she been properly warned.”

As mentioned in the lawsuit, the woman only took the birth control pills to regulate her menstrual cycle. She claims she followed the exact directions for taking the product. Not long after that she experienced the severe stomach cramps and had to have her gall bladder removed..

Currently, there are more than 6,000 pending charges against the companies that manufacture Yaz, Yasmin and their generic counterparts, Gianvi and Ocella explained a NY Product Liability Lawyer. The complaints consistently allege that the manufacturers of the drug did not adequately research possible side effects of their birth control products and did not warn customers of the risk of gallbladder problems, pulmonary embolism, deep vein thrombosis (DVT) and blood clots.

Lawyers pointed out that three bellwether trials have been ordered in the federal consolidated multidistrict litigation in regards to Yasmin and Yaz and have been set for later in 2011 and early 2012. They say the results of those bellwether trials will help determine how settlements are reached in the pending Yasmin and Yaz lawsuits.

Other lawsuits are currently under investigation in Canada as are cases in Manhattan and Staten Island.

Bayer’s response to these allegations states that there is no evidence that Yaz has higher risks than other birth control methods..

$12.9 Million awarded in drug Aredia case

A three-week trial’s recent outcome awarded $12.9 million to the husband of a woman with severe jaw damage as a result of taking the drugs Aredia and Zometa.
The total award amount was reduced to $1.26 million due to the state’s laws limiting punitive damages, according to New York Injury Lawyers.
Jurors came to the conclusion that Novartis Pharmaceuticals Corp., with U.S. headquarters in New Jersey was responsible for the woman’s injuries because they failed to warn the woman effectively about the effects of the drugs. Product Liability is often brought to firms in Long Island and Westchester County.
“The family is pleased the jurors saw the actions for what they were and they’re hoping that Novartis has heard the message,” An attorney in the case said. Another attorney said it “will probably be one of the largest injury awards in the state this year.”
The woman had apparently been taking the drugs for breast cancer had died of osteonecrosis — or bone death — of the jaw, N York Injury Lawyers report. She passed away last year from the breast cancer, according to court filings.
In the lawsuit, the victim’s husband charged that Novartis failed to notify his wife about the drugs’ possible effects fast enough, which stopper her dentists from taking precautionary measures that could have saved her from the jaw damage.
She experienced several dental surgeries and hyperbaric oxygen treatments, according to the lawsuit. In the end these surgeries and procedures poorly affected the quality of her last years of life, according to court reports.
After the woman’s death, her husband continued the case in her honor and as she had requested. “She wanted him to see it through,” his attorney said.

Thousands allege discrimination by the USDA against black farmers

It seems like the world has evolved quite a bit since Rosa Parks refused to give up her seat on the bus, according to a New York Injury Lawyer, but thousands of farmers are claiming that discrimination based on skin color is alive and well in the US Department of Agriculture. 

As if it isn't difficult enough to make a living as a farmer in this day and age, to be discriminated against and refused loans based on your race is ludicrous and it is time that people took a stand against it. Reports received by the New York Injury Lawyer state that thousands of farmers have been denied loans that would have, in many cases, saved their crops and kept their farms going. 

Sources told the New York Injury Lawyer that black farmers who have tried to get loans in the past were treated as though they had no right to even know about loans for farmers, and some of them lost their farms as a result. There have been loans given to black farmers in the past, but the list is long for those who have applied and been denied. 

The New York Injury Lawyer mentioned that the National Black Farmers Association is attempting to get farmers the money that they should have been given twenty years ago. For some farmers who were unable to sustain their crops due to economic difficulties, it is too late. In Manhattan and Westchester County, work injury is a common complaint heard in the courts.

The United States is still a young nation and we have much growing yet to do, but it stands to reason that if discrimination because of skin color is still being used as a determining factor of who gets a money settlement and who doesn't, we have scarcely made it out of the womb.
