Toyota Belatedly Recalls Defective Cars, Says a New York City Injury Lawyer

Almost a year after Toyota recalled trucks and SUVs in Japan with defective steering rods, back in 2005, they finally decided to do the same in the United States, reports a New York Injury Lawyer. Dozens of reports from American drivers regarding steering rods that broke without warning finally prompted the recall, according to a review of company records by a New York Injury Lawyer.
The gap in recall for Japan and the U.S. was very much similar to Toyota’s earlier lapse when some of their cars experienced difficulties with sudden acceleration. The National Highway Traffic Safety Administration has launched a new investigation, which may mean additional fines for the carmaker. The NHTSA has informed New York Injury Lawyers that 16 crashes, including three deaths and seven injuries, could be directly linked to the steering rod defect.
A snapped sneering rod makes it impossible for the driver to control the vehicle, because the front wheels will no longer turn. The U.S. Secretary of Transportation made a personal visit to Japan and warned that further fines may be imposed if Toyota does not improve their safety standards.
“Safety is our number one priority,” the Secretary told a New York Injury Lawyer. The Secretary also added that he was pleased with the measures Toyota has taken to improve its communication with American regulators – if those measures live up to their promise.
When your vehicle breaks down due to manufacturer error, you don’t have to deal with the problem alone. A New York Injury Lawyer can help. The professional skill of a New York Injury Attorney can ensure you get compensated for your loss, so a physical crash does not cause a financial crash, as well.

Deadly Mexican Restauant Shut Down, Says New York Injury Lawyer

The most dangerous thing at a local Mexican hot spot may not be the food at all, but the actual building itself, city officials told a New York Injury Lawyer. Inspectors temporarily shut down the famed Little Italy establishment, which has been known to host such celebrities as Beyonce, Kate Hudson, and George Clooney, stating that the stairway leading to the basement dining room is “imminently perilous to life” in an emergency.
New York Injury Lawyers have discovered a citation from the mayor’s Office o Special Enforcement that states the restaurant does not provide proper egress for employees or customers, and its walls and ceilings are flammable. The owners claim the city approved the setup before they opened in 2005 and again when a new addition was later made, but this time was different.
“They wrote a series of violations all citing the new 2008 building code, even though our building has always fallen under the older code,” one of the owners told a New York Injury Lawyer. “This is going to take days to resolve, at the very least, and we are losing revenue, and paying our staff, which has been with us for years.” One neighbor has lodged 311 complaints about the smoke vented from the restaurant, as well as about the noise from the outdoor seating. None of these complaints had anything to do with the safety violations.
When someone has harmed you or caused you or a loved one suffering, a New York Injury Attorney may be your best resource. The professional skill of a New York Injury Lawyer will bring a swift resolution to what may otherwise be a long and exhausting affair.

Wal-Mart Pulls Miley Cyrus Line of Jewelry Due to Toxic Metal, Reports a NY Injury Lawyer

Wal-Mart made a recent announcement that it is pulling its entire line of Miley Cyrus-brand necklaces and bracelets from the shelves, after testing revealed high levels of the toxic metal cadmium, by the Associated Press, according to a New York Injury Lawyer. It only took three hours after the initial report for Wal-Mart to announce it would pull the jewelry, which was made exclusively for that retailer. They have promised to investigate the matter fully. The statement was made jointly with Cyrus herself and the man who designed the jewelry for the 17-year-old star of “Hannah Montana”.
Wal-Mart Stores Inc. already known of the cadmium content in both Miley Cyrus jewelry, as well as in a line of unrelated bracelet charms for months, based on an early round of tests made by a chemistry professor, but they continued to keep the items on the shelves, anyway. Until recently, Wal-Mart claimed it was too much of a difficulty to test items already on the shelves, tells a New York Injury Lawyer. Wal-Mart’s statement did not disclose whether it would remove the bracelet charms as well.
Cadmium can cause softening of the bones and kidney failure, after long-term exposure. It is also known to cause some forms of cancer, and research suggests it can be detrimental to the development of the brain in the very young. It is not known to be dangerous if simply worn in jewelry, but New York Injury Lawyers are concerned that young children may bite or suck on the jewelry.
Toxins contained in the products we purchase can pose serious health risks. Those affected by contaminated products need the expertise that only a New York Injury Lawyer can provide. The representation provided by a New York Injury Lawyer will ensure your side is heard and your story is told.

Mother Sues Tattoo Parlor for Inking Underage Son, Says a New York Civil Litigation Lawyer

A New York Civil Litigation Lawyer has learned of a Queens mother who is suing a tattoo parlor for tattooing her underage son. She claims he is scarred for life. The mother was shocked to find her son, 17, had the word “Carpe” inked on the inside of one wrist and the word “Diem” on the other, together forming the Latin term “seize the day”. New York Injury Lawyers state that is against state law to permanently tattoo anyone under the age of 18. The lawsuit against the tattoo parlor and the particular tattoo artist who inked the tattoo was filed in Queen Supreme Court.
As for the boy, he told a New York Civil Litigation Lawyer he regrets getting the tattoo. The lawyer continued on to say that removing the tattoos could leave the boy with permanent scars that may look very similar to scars from a failed suicide attempt. This lawyer also knows “for a fact” that the boy was never asked his age when he went into the tattoo parlor.
“It’s not like he presented any type of phony ID,” said the New York Civil Litigation Lawyer. The manager of the tattoo parlor claims the records regarding the boy are now gone. “I didn’t know I was supposed to keep them,” he said.
When someone does harm to you or your loved ones, you don’t have to sit and take it. A New York Injury Lawyer can make those who wronged you pay for their mistake. It will take the expertise of a New York Civil Litigation Lawyer to give you the restitution and resolution you deserve.

Officer Killed By Drunk Driver Honored, NYC Car Accident Lawyer Reports

The family of a deceased Suffolk County police officer recently unveiled signs that officially named an intersection after the officer, reports a New York Injury Lawyer. The intersection at Vanderbilt Motor Parkway and Commack Road is where the 22-year police veteran was killed on February 22, 2009, while he was responding to a call for assistance from another officer. His car was hit by an alleged drunken driver.
As dozens of officers stood at attention, the Suffolk County Police Pipes and Drums Emerald Society played “God Bless America” and “Amazing Grace” during the ceremony. A Suffolk legislator declared to a New York Personal Injury Lawyer the signs would do more than remind others of a police officer who lost his life protecting the public. They are also signs that remind others of the dangers of driving drunk.
The wife of the slain officer agreed. “I hope these signs will be a lesson to be learned,” she told a New York Car Accident Laywer. She continued on to say that her husband’s death “still affects so many people”. The officer’s family will go next to Albany, then to Washington D.C. for memorial services held for officers killed in the line of duty.
The officer’s wife and her children, a 22-year-old daughter and a 20-year-old son maintain a memorial attached to the pole the officer’s car struck. It includes flowers, a teddy bear, and the words, “Don’t drink and drive. Gone Forever.” Prosecutors informed New York Car Accident Lawyers that the 24-year-old Plainsview resident involved in the crash was drunk and talking on his cell phone when he hit the officer’s patrol car.

Staten Island Ferry Failed Before Incident

The Staten Island ferry known as Andrew J Barberi had another crash while being piloted by its assistant captain, according to a New York Injury Lawyer. This is not the first time that the ferry has had issues. In 2003 the ferry became infamous for the horrific 2003 dock crash that resulted in several deaths. In the year 1995 the propulsion system failed which is what failed on the ferry this time. The two front engines did not engage properly and led to the pilot not being able to stop when going into the St. George Terminal. Although questions have arose as to why the assistant captain was at the helm, the DOT has assured that it is normal for the assistant captain to often be at the helm. It was also stated that the Captain of the ferry was standing beside the assistant captain. There were not any alarms that went off on the ferry during this incident.
During a mechanical error it does not always tend to go off. Since this latest incident members from the National Safety Board Investigation have decided to investigate the problem. They will question the maker of the propulsion system that failed as well as any others involved or witness to the crash.

There could have been more injury and more risks to life during this crash if it had not been
for the quick thinking of a bridge operator, reported a New York Injury Lawyer. This bridge
operator lowered the ramp and prevented the ship from heading straight into the concrete.
This person has been praised as well as other fast thinking dock workers. The investigation is ongoing as of now. If you have been injured due to the negligence of someone else, you should put your future in the hands of a qualified professional. Call a New York Injury Attorney today, and let them get you back on the road to recovery.

Sheriff loses job for moonlighting while ‘injured’, says NY Injury Lawyer

A local sheriff has lost his job while on medical leave, reports a New York Injury Lawyer. The sheriff collected over $83,000 during the nine months he was on leave, while still showing up for work at local strip clubs as part of the security team. The sheriff claims that the city was looking for a reason to fire him after he had taken part in a discrimination lawsuit against the city that had been settled for half a million dollars in 2008.

According to a New York Injury Lawyer, the source of the sheriff’s injury was not released, but he was still able to frequent the night clubs. His attorney said that he was not at the club as an employee, but rather going recreationally, and that he was carrying his firearm because as a police officer he always carried it.

The sheriff’s appeal was recently tossed out of court, so he may not be able to fight his dismissal, although he remains true to his prior statement that he did nothing wrong and was fired only as retaliation for his past involvement in the discrimination lawsuit.
The former sheriff was also arrested for trespassing after he continued to show up to court after he had been dismissed, says the New York Injury Lawyer. He is also fighting those charges.

If you find yourself in a dispute with an employer, it is best to contact a New York Injury Attorney. Employment cases can be especially tricky, and the only way to ensure the best possible outcome is by enlisting the services of an experienced New York Injury Lawyer.

Strip-search case in negotiations, according to a Staten Island Injury Lawyer

Nassau County Correctional Center once strip-searched inmates, even those arrested for
minor crimes, until 1999 after a federal judge ruled that the practice was
unconstitutional. The procedure involved full body and cavity searches, without any
privacy or cover. Over seventeen thousand people are hoping for an award of $10,000
each for being subjected to the humiliating and degrading act for a grand total
settlement of $177 million, says New York Injury Lawyers. County attorneys
have filed a counter offer of $200 or less for each person, bringing the total to no greater
than $3.5 million. One of the plaintiffs in the case was a former teacher arrested on an
unspecified charge in 1996. She testified that she was instructed by a female
correctional officer to remove all her clothing, while submitting to a search of her private
areas. It has already been established that the former inmates should not have been
invaded in such a manner, and now the federal judge presiding over the matter has to
make a determination of the damages, if any, to be assigned. The judge first will decide
if any award will go to the entire group due to the general loss of the dignity of a human.
Then he will contend if any additional settlement would be necessary for mental anguish
and pain and suffering. The county attorneys stated to New York Injury
Lawyers
that they are prepared to appeal any damage settlements, including those
made to the group as a whole, based on the theory of the judge in this case is
unprecedented.

If your dignity has been stripped away from you through an unconstitutional act, do not

The ex-boyfriend of a psychic to celebrities is suing his former lover for $14 million in the
Manhattan Supreme Court, claiming that she used his psychological financial weakness
against him. The claim states that the psychic persuaded the man to give her signatory
power regarding his bank accounts, and then drained him out of all of his money
according to New York Injury Lawyers. He, being a best-selling author by the
New York Times, also says that he was the one to launch her into a writing career,
taking her notes and compiling them into a book. He was able to get the advances she
needed for each of her books, which promoted her consulting as well. The suit alleges
that the psychic convinced the man to give her money he received in royalties on his
own writing, which came to approximately $350,000 annually, using his love for her
young son to compel him. The couple met in 1994 and quickly became romantically
involved. He stepped in as a father figure for her son who was two years old at the time.
The psychic was doing readings for some clients, according to a New York Injury Lawyer, but supposedly had very little income. She is therefore accused of taking
advantage of her relationship with the author and preying upon his inability to properly
manage his own finances to support herself. The psychic denies these allegations saying
her former boyfriend hasn't earned his own living in ten years, but was supported by
her.

If someone has taken advantage of you financially, do not think that you can fight them
on your own. You will require the knowledge and training of a New York Personal Injury
Attorney to recover everything that you have lost. Personal injury attorneys can help

News director accused of sexual harassment, states NY Injury Lawyer

The news director of a New York station reportedly asked employees which of the female
reporters was most attractive at a business dinner in 1997. Employees were asked which
they would most likely sleep with as well, reports a New York Injury Lawyer. All
the reporters were mentioned. This specific incident did not occur on company property
or company time. One particular anchor was singled out most by male colleagues on
other occasions as well, often referring to her as "BBB-Big Butt Booty". A picture of her
with her breasts altered to be much larger than they really are could be seen in various
places around the news station, as a former news assistant testified. The female anchor
had complained to Human Resources about issues with the station before, but the HR
director said none of the complaints were of a sexual nature. At least not until the
anchor accused a male reporter of trying to kiss her when he took her home after a
party. The HR director stated to New York Personal Injury Lawyers that the anchor
wanted to handle the situation without her help, despite feeling threatened by the man.
Further testimony resumes on this case in Brooklyn federal court. The lawsuit was filed
by only two of the female employees, the anchor and another reporter against the news
cable channel. It was not mentioned if the other reporter named as co-plaintiff in this
case was subject to any other harassment beyond the business dinner incident.

If you have been the victim of sexual harassment, bring your assailants to justice. Call a
New York Injury Lawyer today and let their knowledge and sharpness go to
work for you. You deserve to be vindicated.

Attorney killed in car crash, states Nassau Injury Lawyer

A deputy attorney for Nassau County was killed in an automobile accident at the
intersection of Maple Avenue and Ellison Avenue. The incident was caused by the driver
of a stolen 2010 Hyundai Elantra. Police from an unmarked car told New York Personal
Injury Lawyers that they witnessed the driver failing to stop for two stop signs before
crashing into the driver's side of the attorney's sedan. They had just turned on their
lights to pursue the Elantra, and were a block and a half away when the collision
occurred. There is no evidence at present that he knew cops were following him for his
reckless driving. He was hospitalized after the wreck at Nassau University Medical
Center. The victim, who had just attended case conferences in court, died at the scene.
A third vehicle was also involved in the incident, however the operator of that car was
treated and released. The Elantra driver currently faces charges of second-degree
manslaughter, and following further investigation, could be confronted with additional
allegations. Arraignment has not been scheduled yet. New York Injury Lawyers
do not have any details at this time about the theft of the Elantra, or why the driver was
driving so carelessly. The deputy lawyer was a well respected mentor and trial attorney
that had been with Nassau County since October 1973. Colleagues and coworkers are
deeply grieved at the loss of their friend. A New York Injury Lawyer was told
that this is not the type of man that can be replaced.

A Queens woman receives $65K from a Personal Injury lawsuit against the NYPD reports a New York Injury Lawyer

Naeema Screven had filed a lawsuit against the New York Police Department in 2007 after she was sprayed with pepper spray. Early 2007, Screven had been running to catch a train, and had run down an up- only staircase to avoid the crowd at the busy Broadway station in Brooklyn, NY. A NYPD Officer claimed he saw Screven’s purse hit several people along the way, so he stopped her and asked for her identification. Screven realized she did not have any identification on her and started dialing a family member to bring it for her. While she was dialing, the police officer sprayed her in the face with pepper spray. The NYPD Officer then arrested Screven for disorderly conduct. She was kept in police custody for over 14 hours. Screven and her New York Injury Lawyer filed a lawsuit against the NYPD in Brooklyn Federal Court based on the over zealous action of the officer. The Court ruled in Screven’s favor and she was awarded $65,000.00 in May 2010.

Staten Island bus driver deemed a hero, boasts New York Injury Lawyer

A bus driver in Staten Island was lauded a hero for retrieving a man from a Sport Utility
Vehicle that was engulfed in flames. The engine burst into flames following an accident.
There are no details or pictures available regarding the crash, and it is unclear if
investigations are still pending. No word was given if any other vehicles were involved or
what caused of the collision, mechanical failure or operator error. The identity of the
driver of the SUV was not revealed to New York Car Accident Lawyers. The NYC transit
driver saw the man trying to get out of the automobile which filled with thick, black
smoke so he helped him to safety. He checked the back first for children, as he is the
father of three year old twin girls, and upon finding no one else in the vehicle, he
assisted the driver. There is no indication that either man was injured in the ordeal. NYC
Transit President and the shop steward of Amalgamated Transit Union Local 516 which
represents Staten Island bus workers, celebrated the heroics of the bus driver. They told
New York Injury Lawyers that he was a special guy that would help anyone in need.
There is no doubt that the transit driver's children will enjoy hearing the story of their
daddy rescuing a man from a burning car, and will most likely request repeated
narratives of the incident. The duration of the man's employment with NYC Transit was
not made known to New York Injury Lawyers.

A New York Injury Lawyer should be called in the event you or a family member has

Attorney awarded full fees, according to New York Injury Lawyer

The lawyer who represented a man injured when a Staten Island ferry crashed has
finally been awarded his full attorney fees from the settlement. In 2008, the attorney
won the case of a man paralyzed from the chest down as a result of the Andrew J.
Barberi ferry accident which occurred on October 15, 2003, reports a New York Injury
Attorney. Due to the age of the incident, details of the crash were not given at this time
as they had been previously reported. No pictures were offered either. The final verdict
was $18.3 million for the injured man, giving the lawyer a grand total of $6 million for
representation. Brooklyn Federal Judge decreased the attorney's compensation to 20%
of the total award instead of the typical one-third shortly after the decision of the case,
says a New York Injury Lawyer. The judge gave the reasoning that the city's
liability for the crash had been proven before the case went to trial, thereby apparently
lessening the amount of work for the attorney. The issue of liability was the main factor
in the judge's decision for the cut, and it is not clear if there were any other contributing
reasons. This reduction brought the total for the attorney to $3,660,000. After an almost
two year battle, the judge has reversed his decision and the attorney will get to keep the
full $6 million. A New York Injury Lawyer should be the first call after an incident in
which you are harmed as a result of someone else's carelessness.

There is no reason to not receive the highest possible compensation when you have
been injured by the negligence of another. Call a New York Injury Attorney today and
get started on the road to recovery, physically and financially. A New York Injury Lawyer
may not be able to take away all your pain, but they can help diminish the mental
anguish and suffering from an accident.

Mine Safety Regulations under review according to New York Injury Lawyer

After the deadly explosion in the West Virginia mine, the President of the United States has ordered that the regulations and laws involving mine safety be reviewed. Current laws are so full of loopholes that unsafe conditions are allowed to continue. Preliminary reports have determined that the blast in the Upper Big Branch mine resulted in some coal dust mixing with a buildup of methane gas, which could have been prevented. The incident is still under investigation for the specific cause of the eruption. A New York Injury Lawyer stated that this particular mine has a long history of safety issues, and is operated by a company being watched closely by officials for significant violations in the past. President Barack Obama is concerned about the amount of mines with inadequate safety procedures in place, and wants these issues evaluated. He has called for strengthening of existing laws and regulations. There are too many companies in which the protection of employees is jeopardized for the sake of the profit margin. The Upper Big Branch mine had 19 times the national rate of violations leading to the shut down of the mine for repairs during the year of 2009, according to a New York Injury Lawyer. These companies cannot continue to operate mines meanwhile disregarding their hazardous conditions, and President Obama has instructed federal officials to step in and work to ensure that preventable disasters such as this explosion do not occur in the future. Preventing future tragedies like this is of national concern.

Families who have been devastated by unsafe working conditions should contact a New York Injury Attorney for review of their case. You have rights and should not go through this without a New York Injury Lawyer.

Fatal Crane Crash the Result of Greed Reports New York Injury Lawyers

The propriator of a crane company said not guilty in the manslaughter charges that were brought up in connection with a fatal accident. A New York Injury Lawyer says the indictment was the result of a fatal collapse of a crane in May of 2008. The crane company allegedly replaced the crane’s broken turntable with a cheaper and less reliable turntable.

A New York Injury Lawyer reports that a crack in the turntable is listed as the reason for a crane falling 200 feet. The operator of the crane and another construction worker died in the incident. The DA in Manhattan said that greed and recklessness were the causes which led to the tragic and unnecessary death of two men”.

All of the defendants in this case enter a plea if not guilty before a Supreme Court Judge. One of the men was released without bail but another received a $100,000 bail that must be posted within a week.

New York Injury Lawyers report that the men insist that nothing they did was to cut corners or knew that the part was not up to par. The crane company is said to have made a bad business decision and profited by replacing the turntable with a cheaper model. However, three building inspectors checked the new turntable visually and signed off on it, as did four independent inspectors.

The Manhattan D.A’s office has charged the company’s owner with manslaughter and has accused another company of employing damaged slings on a crane, which collapsed and killed seven people.

Family Mourns Death of Loved One Says A New York Injury Lawyer

A Ronkonkoma man died in a snowmobile accident and another is in critical condition. The accident took place near Brantingham shortly after midnight when the two men were on snowmobiles and hit several trees on the side of the road. A New York Injury Lawyer may be needed as the case is still under investigation.

State Troopers noted that the curve the men were trying to make wasn’t a difficult curve to get through on a snowmobile but that both men are believed to be drinking alcohol. Both men were however wearing helmets. One man struck a tree and died instantly and the other suffered a head injury and was then airlifted to St. Elizabeth Medical Center in Utica. New York Injury Lawyers can help the family understand what may have happened as well as offer support if foul play is suspected.

Both men were riding Arctic Cat snowmobiles, one a 2002 model and the other a 2000 model. This is the second fatal snowmobile accident involving Long Island residents. A young lady from East Patchogue crashed into a tree while riding a snowmobil in southern Vermont on New Year’s Eve. Steve Bilkis and Associates can be reached at 1-800-NY-NY-LAW for an initial, free, no-obligation consultation.

A Man Arrested Over Disability Claims reports a New York Criminal Lawyer

Anyone who has tried to apply for disability knows that not only is it time consuming and frustrating, the chances of actually receiving disability when first applying is practically naught. So, in many cases, workers who are applying for disability look for someone with experience in this area to help them. And, the criminal charges against a man who has been accused of operating a side business by guiding fellow employees on how to apply for benefits from their job were dismissed but came with a cost.

The Law Office of Steven Bilkis and Associates and its New York Injury Lawyers are available to lend advice to just such individuals. In this case, three remaining charges were dismissed because the man agreed to resign from his job as a budget analyst, pay a $1,500 fine, and file amended tax returns in addition to being prohibited from working as a public official again. Apparently this man was not only operating a side business to help employees skirt the technicalities of the disability application, he had not reported the money to the IRS that he was paid by the individuals.

This is generally considered a white-collar crime, however, this man is no stranger to the law. He was originally arrested two years ago on charges of misconduct and receiving reward for official misconduct. Both of these crimes are felonies. The man was lucky enough to have a Judge dismiss 48 of the 53 charges. The judge stated that although the moonlighting may have been unethical, it was not illegal. The remaining charges of petty larceny and offering a false instrument would be dismissed as well if the man abided by the terms. Obviously, the man was suspended from his job without pay after the arrest.

Study finds that 8% of New York's doctors accounted for 71% of the malpractice payouts says a New York Injury Lawyer

Contrary to what the AMA would have your believe the reason for high medical Malpractice insurance in New York is not because of lawyer suits. But the real reason these rates are so astronomical is the inability of Doctors to regulate themselves. Thankfully, Govenor Paterson’s plan will do that. A start would be to Revoke Doctors licenses who are found to be guilty of multiple medical malpractice. Any experienced New York Injury Lawyer would tell you there is a dangerous short list of Doctors to stay away from. It’s amazing that some of them haven’t lost their licenses already, which would prevent patient suffering and lower the high premiums New York doctors pay for insurance coverage.
Part of the Govenor’s plan would include screening malpractice cases and settlements which would initiate investigations of suspect doctors based on both the magnitude and frequency of the malpractice cases. Despite the best effort of any New York Injury Lawyer to keep Doctors from continuing their reckless behavior, they’re only recourse was to get money for they’re client. Now that the state is monitoring the Docotrs that get sued, a victory not only gets a client money damages but also can potentially stop the doctor from working again.
According to many reports some Doctors have remained in practice after settling over 30 lawsuits from Medical Malpractice attorneys by patients they had seriously harmed. A relatively small number do a huge amount of damage while driving up malpractice insurance rates for all their colleagues.
Paterson also would require HMOs and other health plans to alert the department when they boot a doctor from a network because of incompetence. Hospitals are already required to make such a notification.

Medical Malpractice claims are soaring from plastic surgery says a New York Injury Lawyer

In 2007, inquiries for medical malpractice in our firm were up 50% and half of the increase was from cosmetic-surgery. The most frequent calls we get are from patients who have had breast implants. The chief complaints are the breasts are illplaced or lopsided and loss of feeling around the breasts. People need to research the risks of these procedures. Some are not worth it. We have also seen an increase in calls about Tummy tucks as well.
There have been many complaints that what they expected the surgery to yield didn’t come to fruition. The pictures of these injuries are gruesome. I n osme instances there is no malpractice. There have been cases where the doctor didn’t do anything wrong and the injury that resulted form the surgery was a “ known risk”. The patient signed a release without fully understanding what they were signing and is now living disfigured and in pain. Read the disclaimer and talk t your doctor about the risk of surgery.
There are literally thousands of Medical malpractice claims made to New York Injury Lawyers in New York every year.
That’s why it is so important to know your rights and, if they have been violated, contact a New York Injury Lawyer.

It finally stopped when it struck a LIRR generator. Some of the cars that were involved in the crash caught fire, and 20 people suffered injury. More than twelve of those injured went to the hospital to have their injury evaluated. Kings County Police do not reveal what type of injury those involved in the accident sustained, but do indicate that none of them were serious. The driver who caused the crash is being investigated. So far there is no evidence to support adrug possession charge.

Young Bronx, NY boy suing his school after receiving injury – Should seek the help of a New York Injury Lawyer

Shane Reese, a 12 year old Bronx boy, was sitting out of gym class in Intermediate School 219; located at 3630 3rd Ave. Bronx, NY 10456, last December. He was not playing because he had recently been in a car accident and suffered injury that required dental work. It was raining that day and teachers had brought 6 classes into the gym to play inside. They then handed out soccer balls, instead of soft foam balls, and told the children to play dodgeball. There were more than 100 children into the gymnasium at the time. School officials did not comment on how many teachers were in the gym supervising. During the chaos, one of the dodgeballs flew across the gym and hit Shane in the face, breaking his teeth and ruining his newly repaired dental work. Dodgeball has been discouraged since 1996 but has never been officially banned. Reese’s family has filed a lawsuit against the Bronx middle school. Reports say the school has offered Reese $20,000.00 to settle the case without having to go to court, but the report also says the family will let the judge decide on a fair amount.

New York Injury Lawyer reports a crib recall after infant fatalities occur

Stork Craft Manufacturing of Canada has issued a recall on over 2 million cribs this week. The cribs were made in China, Canada and Indonesia and sold in US stores like Target, Costco and Wal-Mart. The prices ranged from $100-$400 and have been sold since 1993. The cribs that have been recalled have drop-sides, which is where one of the sides slides down to make it easier to access the child. The side though, can come loose or have parts go missing after a while. That creates a gap that a child can fall through. That gap has caused four infant fatalities which could call for a New York Criminal Lawyer to be involved. Stork Craft Manufacturing has also issued repair kits for those who want to keep their cribs. The kit will prevent the side from dropping down. Reports do not indicate if the families of the children have filed a lawsuit against Stork Manufacturing but Endangering the Welfare of a Child is not out of the question.

Kite fighting has become a popular “sport” in Queens County lately. It originated in South Asia and has made its way into American culture from movies and books. The fighters use kites that an abrasive wire line to try to cut the other fighters kite. These fights have been happening regularly in Flushing Meadows Corona Park; which is located in Flushing Meadows, NY. A stray kite had made its way to Flushing, NY where 12 year old Jared Koeloff was skateboarding down his street. The wire slashed his throat. The injury was so bad the boy had to get rushed to the hospital where he received almost 500 stitches to close the wound. He also lost 2 lymph nodes due to the incident. Queens County Police found the kite on the roof of the building. The report it had also 300 yards of glass encrusted wire attached. The wire is so sharp; it has to be reeled on a power drill instead of a normal kite reel. Koeloff’s family has filed a lawsuit against the city claiming the city knew these potentially dangerous fights have been going on and have not stopped them. The also claim the city failed to remove the hanging wire at the construction site that caused such injury to the young boy. SPINAL INJURY ERRANEOUSLY TREATED for ACTUAL BLADDER PROBLEM SAYS A NEW YORK INJURY LAWYER

34 year old Minerva Peña, a health-care aide developed pain that was located in her lower back in spring of 2003. Peña claims that the pain flourished after a procedure that resulted in the removal of fibroids. Months later Peña had a sudden pain in her legs and lost temporary control of her bladder and bowels. She returned to her OB/GYN, Newsam where she complained that she had pain and urinary inconsistency. Newsam claimed that this could have been a neurogenic disorder of the bladder, where she prescribed some medication and made a follow-up appointment. After this Peña continued to have problems with her bladder, she was no longer able to urinate and retained large amounts of her urine. When she returned to her OB/GYN, Newsam performed a catheterization, which is the process of inserting a flexible, narrow tube into the urethra for the purpose of draining out any liquids that may be present. Newsam was able to drain 3,000 cubic centimeters of urine out of Peña’s body. Newsam sent Peña to St. Barnabas Hospital in the Bronx, where she was hospitalized for “suspected” Upon the consultation of neurologist, Segan, it was determined that Peña did not have Cauda Equina Syndrome. An MRI was intended but the plaintiff suggested that her pain wouldn’t allow her to assume the position that the MRI required, therefore the MRI was postponed for a week later. The results of the MRI were that Peña did indeed have Cauda Equina Syndrome, the condition was then addressed through a surgical procedure, Peña will still experience permanent pain and dysfunction of her bladder and bowels. Therefore she filed a suit against Newsam, Segan, Colucci, St. Barnabas Hospital, and several of the clinics related to the hospital.

She claimed that the parties mentioned above failed to diagnose her condition in a timely manner. The plaintiff sought compensation for part and future pain and suffering. The plaintiff ultimately discontinued the claim against Colucci but proceeded against the remaining defendants. Prior to the start of the trial the parties negotiated and settled for 1.5 Million Dollars. Segan’s insurer contributed $1.15 Million, Newsam’s insurer contributed $250,000 and St. Barnabas Hospital’s insurer contributed $100,000. There were no criminal charges filed and usually in these cases that is not unusual.

Roger Clemens who was formally known as a Yankee pitcher always battled through the many difficult situations he faced on the field and is not ready to give up the suit against his former trainer, Brian McNamee. McNamee accused Clemens of using Steroids [also known as performance enhancing drugs]. The motion will be filed on the 5th Circuit of the United States Court of Appeals. Clemens accuses his former trainer of falsely claiming that he injected him with Steroids between 1998 and 2001, numerous times at his apartment in New York City. Most of the case was dismissed by United States District Court Judge Keith Ellison claming that he was coerced by the government to render information pertaining to Clemens’s drug use. On the controversial side McNamee has filed a suit against Clemens alleging that he defamed him in attempt to ruin his reputation and inflicted emotional distress on his person. Landmark win for hurt officer-a NY Injury Lawyer can help you

Back on August 1, 2005, NYPD officer Maureen Cerati, was horribly injured by a hit-and-run driver. Just before 3 a.m. Cerati was working on a crash scene on the Belt Parkway, where the DWI, Oscar Berrios, had flipped his car, killing one of his passengers. While working on this incident, ex-con Deirk Keitt drove by, slamming into Cerati, and dragging her over 100 feet along the parkway. She suffered multiple injuries, some very serious.

A precedent was set when the state Appellate Division ruled that Cerati can sue both Berrios and Keitt. The NYPD officer was thrilled with the decision saying, “Officers are often told, ‘It’s all in a day’s work.’ It’s very gratifying to see that if officers are hurt in the life of duty they will be taken care of by the authorities.”

The civil suit against Keitt was settled, but Berrios did not believe that he was responsible because his car never touched the cop. Under the existing law, Cerati’s law suit against Berrios would have been tossed, but this appeals decision means that it won’t likely happen. Cerati’s lawyer, Joseph Decolator says that anyone whose negligent or criminal acts bring a police officer to the scene is equally liable with the person who directly caused the inuries. This landmark court ruling gives cops more leeway over who they can sue for on-the-job injuries.

Veteran transit worker, George Nunez was awarded $13 million after falling 30 feet from an elevated Brooklyn subway track and spending two months in a coma.

The 51-year-old, father of three was replacing the old wooden slats, back in 2006, on the J train in Bushwick when the plank broke below his feet. While working on the track, he was unaware that the metal bolts that secured the track were cut. A judge is dismissing the NYC transit lawyer claims, blaming Nunez for not being hooked up to his safety harness. Supervisors on the scene said that Nunez was never told he needed to be attached, because they were unaware that the bolts had been cut.

Even though George Nunez was wearing a safety helmet which partially shielded his skull, he has lingering brain damage and metal plates in both of his arms, and his face and pelvis were shattered. George and his wife, Evette Nunez, who was also named in the lawsuit, were awarded the $13 million by a jury of their peers after a three-week trial in Brooklyn.

A shooting of an unarmed man occurred on January fourteenth, 2009. The incident took place in Freeport, New York.

Frantz Byer, 22, of Freeport, was attending a barbeque on Leonard Avenue when police approached. The police had been called from an unknown pedestrian reporting a man with a gun on the street. When Byer was approached, police officers say that he allegedly pointed a revolver at them. The officers then shot him, Byer was only holding a bottle of Jack Daniels whiskey and a friend of his, Michael Wright, 23, of Freeport, says that he was intoxicated at the time from drinking at the barbeque. Another acquaintance of Byer, Tyrik Reese, also from Freeport, says that Byer was holding a whiskey bottle when police confronted him and that he heard the bottle smash.

After being shot, Byer suffered from several gunshot injuries. He lost a kidney and now limps while walking.

When Byer’s case was brought to trial that same day at Nassau County Court, defense attorney Fred Brewington represented him. In court, Brewington began calling witnesses to the stand. Byer was charged with weapon possession and threatening police. But, Brewington requested to Judge John Kase that he is released of weapon possession charge. The judge has not yet decided a decision. Brewington also showed that the smashed gun pieces did not belong to Byer and that it did not work.
