A New Jersey jury has found the Swiss drugmaker, Novartis AG, did in fact provide clear warning about the risk of its bone-strengthening medicines, ending the lawsuit of a woman who claims the drugs destroyed her jaw, sources told a New York Injury Lawyer.
The 73-year-old plaintiff sued Novartis when she developed damage to her jaw while taking drugs to slow bone loss as she fought against breast cancer. A New Brunswick, New Jersey jury ruled Novartis gave sufficient warning to the plaintiff’s physician regarding the drugs the plaintiff was taking. “There is not anything in this record to show that Novartis deliberately concealed anything,” a company attorney told a New York Injury Lawyer.
This is the second product-liability case to go to trial over bone-strengthening treatments, which had sales in 2009 for $1.5 billion. Both drugs are still on the market. The New Jersey plaintiff sought unspecified damages for pain, suffering, and loss of enjoyment of life. Her 75-year-old husband also sought damages for his loss of consortium, society and services. She testified in her trial that the drugs only advanced her condition, known as osteonecrosis. She had no comment after the verdict was handed down.
