What Did Brett Favre Do, Exactly?

For now, at least, the behavior of Minnesota Vikings quarterback Brett Favre is not a legal issue, but something for the NFL commissioner to mull over, according to a New York Injury Lawyer.

The league is investigating whether or not Favre acted inappropriately toward a Jets employee while he was with the New York Jets in 2008. What about the photos? The attorney continued on to say, “that’s a First Amendment issue, which is protected as long as it isn’t child pornography. You could even say it’s art.” The NFL commissioner did not state exactly what policies Favre may have violated. Favre himself apologized to his team for causing the distraction before his team lost a game to the Jets.

The usual legal standard for sexual harassment includes the following: unwelcome advances; pervasive behavior that creates a hostile work environment; and the filing of any complaint. The league, however, can disclipline players without legal charges, by imposing a fine or suspension.
