Veteran transit worker, George Nunez was awarded $13 million after falling 30 feet from an elevated Brooklyn subway track and spending two months in a coma.

The 51-year-old, father of three was replacing the old wooden slats, back in 2006, on the J train in Bushwick when the plank broke below his feet. While working on the track, he was unaware that the metal bolts that secured the track were cut. A judge is dismissing the NYC transit lawyer claims, blaming Nunez for not being hooked up to his safety harness. Supervisors on the scene said that Nunez was never told he needed to be attached, because they were unaware that the bolts had been cut.

Even though George Nunez was wearing a safety helmet which partially shielded his skull, he has lingering brain damage and metal plates in both of his arms, and his face and pelvis were shattered. George and his wife, Evette Nunez, who was also named in the lawsuit, were awarded the $13 million by a jury of their peers after a three-week trial in Brooklyn.
