The Dallas County commissioners, who have seen mounting lawsuits over constable actions, are attempting to get legislation passed that would protect the county when elected officials step outside their boundaries and create personal injury situations.

The county attempted to get a similar bill passed in 1999, but heavy opposition from various businesses and associations doomed the bill early on. Since 1999, the county has been hit with numerous lawsuits, mainly having to do with the actions of elected officials, stated a source.

The county budget office has reported that they do not track how much the county has spent defending itself against such lawsuits. Commissioners have already limited the liability by eliminating constable traffic units and constable canine units.

A federal jury in Islip, New York, has ruled for Toyota in a case of sudden acceleration in New York. This is in Suffolk County and near Nassau County.

The jury deliberated for less than an hour before finding Toyota was not responsible for a doctor’s 2005 Scion sudden acceleration and collision into a tree, sources tell us. The jury found the driver to be at fault, instead.

It was all the driver, not the brake or the floor mat which may have caught the accelerator, a lawyer for the car company reported. The doctor “made a mistake in the operation of his 2005 Scion TC”, the lawyer said to the jury. “He made a simple but unfortunate mistake.”

A “brilliant” and “vibrant” senior was found dead early Wednesday after her hair apparently got caught in a lathe during a laboratory accident. The Yale Community is in mourning.

The astronomy and physics major was just weeks away from graduation and was looking forward to beginning a career in oceanography after she graduated. She had spent last summer working as a student fellow in the competitive Woods Hole Oceanographic Institution in Woods Hole, Massachusetts.

The young scientist was working on a class project when the accident occurred. She was in the Sterling Chemistry Laboratory. Other students working in the building found her body and called police between 2 and 3 a.m.

Mystery car accidents are frustrating for the police, particularly when it involves children, as in this case, commented the New York Injury Lawyer. The 15-year old was ejected from the car she was riding in when it veered off the road and went into a roll over. She was dead on impact with the ground.

The vehicle in which she was riding had been headed to the nearest town and was being driven by an 18-year old young man, who didn’t have that much experience driving. Ambulance crews took him to the hospital, where he was treated for minor injuries and discharged. As soon as he was discharged, he was arrested. Another 21-year old man was arrested at the scene of the accident.

Police aren’t certain yet as to what happened to cause the first car that the young girl was riding in to go off the road, but they have suspicions that the two cars that were traveling together, were speeding and racing one another. The police are asking for any eye witnesses to come forward and help them with the investigation. They particularly want to talk to anyone who saw the blue Corsa before it flipped or a white Ford Fiesta. They’re hoping they can get to the bottom of what caused this fatality. Authorities in Nassau and Suffolk Counties are watching this case carefully.

An accident in Baiting Hollow ended in the death of one and injured eight others. It occurred on Sound Avenue when a tractor-trailer collided with a school bus for special-needs children. So far, it seems that the fatality and most, if not all, of those injured, were adults.

According to a police chief in the area, the bus was the property of Maryhaven Center of Hope in Poor Jefferson. The tractor trailer was carrying a load of sand. According to New York Injury Lawyers, the street is both hilly and curved, which made it easy for the bus and tractor trailer to lose control when they sideswiped each other.

A dispatcher for the Maryhaven Center of Hope told New York Injury Lawyers they are a program for children with special needs. At the time for the accident, there were six students and two staff members on the bus.

A hit-and-run driver from Massapequa Park is attempting to prove he did not run from the scene of an accident that killed a pedestrian from Bellmore. The 45-year-old defendant was silent was at his arraignment in Nassau County First District Court in Hempstead.

He is now free on $10,000 bail, but his driver’s license has been suspended for 30 days to allow a judge to review the defendant’s record and assess the possibility of him driving again at some point in the future. Leaving the scene of an accident with death is a felony charge, which gives the defendant plenty of motivation to fight it.

Delaware is one of six states in which the Diocese has filed for bankruptcy as a result of dozens of sexual abuse cases being brought to light against priests, reports a N York Injury Lawyer. this disturbing trend keeps happening in states all across the country. It seems as if the dirty little secret that has been kept hidden by the church for dozens, if not hundreds of years, is finally coming to light. The fallout is worse than we would have imagined. 

The Delaware Diocese has agreed to pay each of the more than 150 adults who are claiming to have been molested by priests an excess of $350,000 in order to end the cases and put that dirty shadow of a past behind them, explains the New York Injury Lawyer. Over the years, as more people have come forward with charges of sexual abuse perpetrated by priest onto young children, it has become more and more difficult to put our faith and trust in the church that seems to be doing the most harm that it can upon its congregation. 

It is assumed that the majority of the adults who have filed cases against the Church will accept the settlement. Other states in which the Diocese has filed for bankruptcy as a result of sexual molestation charges against children by priests are Oregon, Texas, Iowa, Washington and Arizona. 

When the people who we have been expected to trust harm our children in the worst ways and with utter deception, there really is no way to come out ahead, and this settlement does not feel like a victory for many of the adults who were molested as children. In Nassau and Queens this might be considered premises liability since the church in many cases owns the land or building. Two suffered injuries when a sport utility vehicle flipped over near Exit 17 of the Southern State Parkway in Malverne, New York State Police have stated.

The injured people were not identified, but police assured New York Injury Lawyers their injuries were not life-threatening. The SUV flipped over in the westbound lane at about 9:20 in the morning.

One of the injured persons was taken to Nassau University Medical Center in East Meadow and the other to Winthrop University Hospital in Mineola, a state trooper told New York Injury Lawyers. The cause of the accident remains unknown, as does the possibility of criminal charges. Police managed to clear the scene in about three hours.

Three Prince George’s County police officers shot and killed a man wielding an axe in front of a day care in the Glenn Dale area in what could be a case of wrongful death.

Just before 3 p.m. on a Thursday afternoon in early April 2011, police were forced to take action, after being called to the daycare to address reports of an armed man, a county police spokesman told NY Injury Lawyers.

The man in question was part of a child custody dispute and wanted to take his children out of the daycare, the police spokesman said. The daycare then called the mother of the children who instructed the caregiver not to give the children to their father.

It was reported in the news recently that the makers of Lean Cuisine issued a voluntary recall of its Spaghetti and Meatball product due to some pieces of red plastic having been found inside the packages, claims a New York Injury Lawyer. What is puzzling the folks at Nestlé, the parent company of Lean Cuisine, is that the pieces of red plastic seem to have come from an emergency stop button.

Sources tell reporters that the emergency stop button is located at various locations along a manufacturing line so that any worker who spots a problem along the line can stop it so that no further problems can occur until that particular problem is corrected. The process has been proven to work at manufacturing facilities throughout the world. What is puzzling about this case is that Nestle says that the way the plant was designed that no emergency stop button is located near those areas that food would be moving past.

As part of Nestlé’s ongoing investigation into how the plastic could have gotten into the product, they have gone so far as to contact their suppliers to see if any of the ingredient shipments could have contained the plastic, the New York City Injury Attorney was informed.
